Item: IPC धारा 91 – अपवादों का अपवाद (Exclusion of acts which are offences independently of harm caused)

कोई कार्य यदि स्वयं में ही अपराध है,
तो यह मायने नहीं रखता कि उसने किसी को नुकसान पहुँचाया या नहीं —
वह फिर भी अपराध माना जाएगा।

 

🔹 उदाहरण:
आत्महत्या का प्रयास (धारा 309) —
इसमें किसी दूसरे को कोई हानि नहीं होती,
लेकिन फिर भी यह अपराध है क्योंकि कानून में इसे अपराध घोषित किया गया है।
